Corboy & Demetrio Files Lawsuit against Uber in Crash that Seriously Injured 73-year-old Pedestrian
Corboy & Demetrio Partner Francis Patrick Murphy has filed a lawsuit on behalf of Mary McKeever, a 73-year-old pedestrian who was seriously injured when an Uber driver plowed into her while she was in a crosswalk, landing on the hood of the car and carried 30 feet before falling off.
Uber Technologies and Uber driver Balaram Pokhrel are named as defendants in the lawsuit, which was filed in Cook Co. Circuit Court on Oct. 2, 2019.
The crash occurred on Wednesday, September 25th, about 2:30 p.m., when Mary was crossing Clark Street at Schubert Avenue in the marked, brick crosswalk. There are no traffic signals at this T-intersection.
The Uber vehicle was making a left turn from Schubert to go north on Clark Street. He hit Mary in the crosswalk. She fell onto the hood of his car and fell off when he stopped about thirty feet away.
Mary suffered serious face and brain injuries.
Although an eyewitness claimed Mary was crossing mid-block, Murphy found that a restaurant near the intersection, thankfully, had a video that recorded the incident. The restaurant shared the video with Murphy. It shows clearly Mary was where she should have been—in the crosswalk.
“Professional drivers working for Uber must pay attention. Mary was where the law says she should cross the street: in a marked crosswalk. This is her safe haven. Motorists must yield to her!” said Murphy. In addition to Mary, Murphy also represents Mary’s husband in the lawsuit, which seeks unspecified damages for Mary’s injuries and her husband’s loss of consortium.
